LEXSTONE AVOCATS establishes the fees for the legal service it provides with the client’s agreement. Following the presentation of its legal advice and assistance needs, your firm defines with the client the major orientations of the strategy to adopt, whether the action takes place in defence or in demand. The fee agreement sets the purpose of the legal service, the calculation of the fees and their method of payment.
Registered with the Draguignan bar, the lawyers of your firm send the client a quote informing him of all the costs and charges generated by the case to be handled. In complete transparency, your lawyers, Maîtres Josselin Bertelle and Pierre Crépin, explain to the client the firm's remuneration criteria.
The attorneys’ fees are calculated on the basis of several criteria such as the nature of the case to be handled, the reputation of the law firm, as well as the financial possibilities of the client.
A file without hazards will be resolved quickly, while a complex civil case or foreign nationals’ case in Puget-sur-Argens may extend over time or require more resources, and therefore, higher remuneration.
The lawyer informs the client about the various costs not included in the fees (travel costs, bailiffs' fees, experts, disbursements, etc.), about the payment of provisions at the start and during the processing of the case.
If a client experiences financial difficulties, the lawyer can refer them to the authorities granting financial support to litigants whose resources are insufficient to take legal action. In any case, the lawyer ensures that you are not covered by legal protection which will reduce your costs.
Finally, the lawyer keeps the client's accounts up to date and regularly informs him of expenses and provision needs.
Depending on the case handled by the LEXSTONE AVOCATS firm, the fees are calculated using one of the following methods. Remuneration is paid in one or more installments, depending on the provisions paid at the start of the file. The final invoice takes these provisions into account, whether the fees are based on time spent or on a fixed price basis..
- Fees for time spent
The processing hours devoted to the file are counted, then multiplied by an hourly rate agreed in advance.
- Flat rate fees
A fixed amount to fully cover the lawyer’s service is agreed. The customer can pay this amount in several installments in the case of creating provisions. If another service is required, a new fee agreement is established.
- Fees based on results
Depending on the payment method, fixed price or time spent, remuneration is set. Then, depending on the outcome of the case handled, an additional amount is paid by the client. A fee agreement based solely on results is prohibited by law.
The client who does not agree with the lawyer's billing has the right to contest the fees. To do this, he contacts his lawyer in order to obtain explanations or proof of the costs he is denouncing. He then sends a registered letter with acknowledgment of receipt which will include the disputed documents.
In the absence of a satisfactory response, the client can contact the President of the Puget-sur-Argens Bar Association or the consumer mediator of the legal profession. In both cases, he sends a letter summarizing the dispute with supporting documents (photocopies of invoices, fee agreement, etc.), by registered mail with acknowledgment of receipt. If no arrangement is possible, the President of the President makes a decision within the allotted time frame. If the decision does not suit him, the client can contest it before the First President of the Court of Appeal.
